Applications by European Costs Lawyers practising in England and Wales to be registered with the Association of Law Costs Draftsmen
The European Services Directive 2006/123 became national law on 28th December 2009. The Association of Law Costs Draftsmen is a competent authority and is required to regulate qualified costs lawyers in England and Wales. A costs lawyer of an European Economic Area (EEA) State or Switzerland has the right to provide services in the UK on a temporary or occasional basis. The rules applying to a costs lawyer registered in his host state shall prevail to such a lawyer shall prevail where there is a conflict of rules. A register of European Costs Lawyers registered with the Association will be maintained by the Association. Once registered, the lawyer is subject to the same rules and discipline as a member of the Establishment Directive profession in the host state, and is allowed to do work reserved to members of that profession. No registration fee shall be payable by individuals registered on a temporary and occasional basis under the provisions of European Directives.
